#General conditions of use and sale of the SMARTFENCER® mobile & web applicationEffective date: October 1, 2023Welcome to the SMARTFENCER® mobile & web application (hereinafter referred to as “the Application”).
The SMARTFENCER® General Terms and Conditions of Sale and Use (hereinafter referred to as "Terms") establish a legal contract between the user and the company operating the Application. They constitute an essential element to guarantee safe and fair use of the Application.
Before you begin using SMARTFENCER®, please read these Terms carefully, which govern the rights and responsibilities of users when using the Application, as well as payment terms, refund policies, and much more.
By downloading, installing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.## 1. Application descriptionSMARTFENCER® is a web application - accessible on smartphone or computer, designed to help competitive fencers and their coaches better analyze, monitor and improve their performance in competition. The application provides a framework for analyzing match data, highlighting areas of strength and areas for improvement. The application does not replace the coach: it facilitates the work of the fencer and the work of the coach in identifying areas of strength and areas for improvement## 2. Use of the Application### 2.1. EligibilityUse of the Application is reserved for users aged at least 13 years old. If you are under 13 years of age, you may not use the Application. Furthermore, this application remains mainly intended for experienced fencers who are involved in a sports performance project, and in regular competitive practice. Using the application requires having a good technical foundation in fencing, and having video supports (matches filmed during official competitions under the aegis of your sports federation).
The user must be aware that use of the application requires an internet connection and a compatible device (smartphone or computer).### 2.2. User accountTo access the Application, you must create a user account.
When creating your user account on the Application, you do not have any subscription. To access the features of the Application, you will need to take out a subscription from your personal space on the Application to activate either a “fencer” profile or a “coach” profile. It is not possible to combine the 2 profiles on a single account.
The payment and reimbursement terms are specified in paragraph "## 3. Paid Services" and following.
By choosing the “fencer” profile, you will access all the analysis modules offered by the application. With a “fencer” profile, however, you can share all of your data with one or more users with a “coach” profile, securely in the Application.
You can also share a single match analysis dashboard with a third party, via a public link. In this case, you are responsible for choosing the third party(ies) to whom you share this link.
By choosing the “coach” profile, you will not have access to all of the application’s analysis modules. However, users with a “fencer” profile will be able to easily give you access to their data by consenting to link you to their account. So, with the “coach” profile, you will have a “list” of “fencer” profiles to which your “coach” profile has been linked. For each of these fencers, you will be able to explore the data from all the matches analyzed. It will also be possible for you, in your capacity as coach, to provide your analysis and comments on each of the matches analyzed in a space dedicated to you. These comments will be viewable live (but cannot be modified) by the concerned fencer, in his/her interface.### 2.3. Lawful useYou agree to use the Application in accordance with all applicable laws and regulations. You must not use the Application in an abusive, fraudulent or illegal manner, or for any defamatory, offensive, illegal purpose or to infringe the rights of third parties.
You guarantee SMARTFENCER® against any false identity, when creating your account or making your various payments.
Regardless of your profile, you are responsible for the accuracy of the information provided when using the application and the confidentiality of your connection information. You should ensure that you do not share them with third parties and restrict access to your device. You agree to take full responsibility for all activities that occur through your account.
We emphasize the “private” nature of the analysis work carried out by each user. Match analyzes must not be shared publicly: they constitute a working tool for the athlete and possibly his coach. They constitute a tool aimed at promoting the athlete's progress and can be integrated into training planning.### 2.4. User-generated contentThe Application allows users to generate analytical content about matches (hereinafter referred to as “User Generated Content”). You are responsible for the Content that you generate and publish as a user, and you warrant that you have all necessary rights to do so. SMARTFENCER® reserves the right to remove any User-Generated Content deemed inappropriate, without notice.## 3. Paid servicesThe features and services of the Application are subject to payment. The fees associated with the use of these paid services will be clearly indicated in the Application before the purchase, depending on the user profile defined when the account was created ("fencer" profile or "coach" profile). Payments will be made according to the terms specified at the time of the transaction.### 3.1. Subscription, payment and billingThe Application offers different subscription plans (annual for “coach” profile, monthly or annual for “fencer” profile), each with its own features and prices.
As a user, you are free to choose the plan that best suits your needs and to make payment, with the payment provider Stripe (hereinafter referred to as "Payment Provider").
The Payment Provider provides secured payment interface and system, accessible from the Application, and the bank card is the only means of payment available in this interface.
To take out a subscription, on the payment interface managed by the Payment Provider, you will communicate your banking data and the necessary information at the time of the order and you alone ensure their accuracy (name, first name, address, email, phone number) and you will confirm your wishes to pay by validating the various payment information.
The functionalities of the “fencer” or “coach” profile that you have previously chosen will be immediately available in your space, subject to validation of payment by the Payment Provider.
You can connect to your personal space in the Application at any time to view your invoices or modify your subscription.
All payment information is processed securely through the Payment Provider and in accordance with SMARTFENCER® Privacy Policy.### 3.2. Refund policySMARTFENCER® offers a free trial period to allow the user to test the application before committing to a paid subscription. If the user is not satisfied with the application during this period, he may cancel his subscription and request a full refund. However, once the trial period is over, any payments made are non-refundable.## 4. Intellectual property### 4.1. CopyrightsAll intellectual property rights relating to SMARTFENCER® and the Application, including, but not limited to, trademarks, logos, text, graphics, videos, images and other content of the Application, are the exclusive property of SMARTFENCER® or its licensors.
You may not copy, modify, distribute, transmit, display, distribute, sell, license, use or in any way exploit the content of the Application without the prior permission of SMARTFENCER®.### 4.2. User-Generated ContentBy posting User Generated Content on the Application, you grant SMARTFENCER® a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license to use, reproduce, distribute, display and exploit such User-Generated Content as part of the operation of the Application.## 5. PrivacySMARTFENCER® respects the privacy of its users.
Our Privacy Policy explains how we collect, use and share information you provide to or through the Application.
By using the Application, you agree to our Privacy Policy.## 6. Limitation of liabilityThe Application is provided “as is” and SMARTFENCER® does not guarantee its uninterrupted, secure or fault-free operation, defects or breackdown. SMARTFENCER® cannot be held responsible for direct, indirect, special, accidental or consequential damages resulting from the use or inability to use the Application.## 7. Modifications to the ConditionsSMARTFENCER® reserves the right to modify these Terms at any time. Changes will be effective upon posting on the Application. It is your responsibility to check the Terms regularly to ensure that you are still in compliance. By continuing to use the Application after changes have been posted, you accept the revised Terms.## 8. Right of withdrawal & CancellationThe regulations (https://www.service-public.fr/particuliers/vosdroits/F10485) stipulate that the right of withdrawal does not apply to purchases of “digital content provided on an intangible medium and subscription contract to these services whose execution began with your agreement and for which you have waived your right of withdrawal”.
Therefore, as a user, you waive your right of withdrawal. SMARTFENCER® therefore has no legal obligation to provide a refund.
You can cancel your subscription at any time by following the instructions provided in the Application and by the Payment Provider.
SMARTFENCER® reserves the right to suspend or terminate access to the Application in the event of violation of these Conditions or any inappropriate or illegal behavior. In this case, the user concerned will not be entitled to any refund.## 9. CommunicationWe may use your email address to send you information about updates to the Application, new features, promotions or other relevant communications related to the Application. You may choose to no longer receive these communications by unsubscribing via the links provided in the emails.### 3.3. Aggregated DataWe may aggregate the collected data to create general statistics and analyses, for the purposes of research, development and improvement of the Application. This aggregated data does not allow direct identification of individual users.

We do not sell, trade or rent your personal information to third parties for their marketing purposes. However, we may share your personal information in the following circumstances:### 4.1.
